Terms of Service
This Terms of Service (hereon referred as “Terms”) pertains to the website GadgetLifeline.com (the Website) which is owned by Hummingbird International, LLC (referred to as “Company”, “we”, “us” and “our” throughout this Terms). The Company offers electronics recycling services, tools, shipping, and payment through the Website to the user (“customer”, “visitor”, “you”, “your”), which are conditioned upon your acceptance of the terms, policies, and notices stated as under. By visiting GadgetLifeline.com, you agree to these Terms. If you do not agree to the Terms, please do not visit the Website.
Trade-in Service: The Company offers trade-in service (hereon the “Service”) to users for recycling their electronics gadgets (including devices, smartphones, smartwatches, PC desktops, servers, tablets, etc.) at GadgetLifeline.com.com where they can sell their used devices after receiving a quote (“estimate”), from us. By participating in the Service, you agree to the terms and conditions set forth. Any and all transactions conducted on this Website are solely the responsibility of the users and the Company. You agree that the information provided about your device is legitimate and accurate.
To sell your electronic device (or “gadget”) on our Website you are required to:
a. Provide accurate and up-to-date information about your device and about yourself;
b. Only sell on behalf of yourself and not somebody else; c. Be at least the legal age of 18 years to enter into the Terms; d. Comply with all the terms and conditions set herein.
c. Your device was manufactured at least in 2008. Older models will not be accepted. Your device has the original hardware from the manufacturer and has not been altered. Any other specifications should be reported to us before you send your device in.
Removal of Data from Device
Before you transact with us, you agree to remove all types of personal data and passwords from your device before shipping it to us. By shipping your electronic device to us, you acknowledge and release all claims on the device including data stored in the device or any media-related information used in conjunction with the device. This claim release also includes data integrity, security, confidentiality, disclosure, or use. You are solely responsible for the removal, and security, of data stored in your device, and transfer to another medium. GadgetLifeline.com.com is not responsible for any data lost or erasure once we receive your device. We make a reasonable effort to erase all data on devices shipped to us but cannot make any guarantee in this regard. Any data left on your device may be accessible by others and is not our responsibility to secure, protect or keep safe including hard drive, CD ROM, disk, or any other storage media.
When we receive your device, it goes through a testing process that includes verifying the configurations, model, brand, and condition as listed by you.
a. The device model, configuration, and condition must match the description given at the time of trade-in estimation. If they do not match then we reserve the right to re-evaluate and send a new estimate based on the actual condition of the device. You may accept or reject the new trade-in valuation.
b. All devices must have a legible COA and product key. If your device has an OS backup partition, restoration CD or USB is not necessary. If your device does not have a backup partition, you will need to include the restoration software and drivers with it. Failure to do so may affect your quote. We may, at our discretion, offer some trade-in value for devices that display functional conditions that we did not prompt for, such as no boot or no power.
However, we reserve the right to reject any trade-in for conditions that affect the operation of an item.
c. Items with scratches, dents, scruffs, cracks, or malfunctions such as power on/off, batteries*, LCD, etc. will automatically have significantly lower valuation at the time of trade-in. You agree that you have listed all issues related to your knowledge and guidelines on our website. However, if this was not communicated earlier and emerges during the testing process, then you may get a revised estimate for your device.
d. All testing processes take at least 48 business hours. To avoid delay in payment, make sure you specify the condition of your used device correctly and accurately before shipping to us. All quotes are valid for 7 days. If we receive your device after this period, your device will go through a testing process and you will be offered a new estimate based on the result of the testing process. You may choose to accept or reject the new trade-in offer based on the new estimate. Should you reject the revised trade-in offer, any leftover disks, SD cards or similar peripherals will be discarded and may not be returned to you.
e. Packing and shipping may impact the condition and final assessment of your device. For this reason, you agree to receive a revised and final estimate based on the condition we receive your device. Your payment will be based on this final estimate. (*Device batteries should have 70% charge or will be considered as malfunction.)
If you fail to refuse or do not respond within 10 days of any communication regarding your order, then we will consider it your acceptance and process your payment as per the revised payment terms provided in the new communication sent via email. Once the payment is issued, the device will not be returned and will be sent for recycling.
Under no circumstance will we accept devices sold under misrepresentation.
a. If the description of your device is misrepresented, you will be emailed with a new trade-in offer. You may accept this offer, or reject it. Upon rejection, your device will be returned to you for which you will provide us the return label. It's your sole responsibility to provide the return label at no cost to the company.
b. If you fail to refuse or do no respond within 10 days, then we will consider it your acceptance and process your payment as per the revised payment terms provided. Once the payment is issued, the device will not be returned and will be sent for recycling.
c. If you are not the sole owner of the device then you are not authorized to sell the used device to us. This includes devices purchased under installment plans with installments still left to be paid off. You must not violate any applicable laws, statutes, ordinances, or regulations including export laws. You are responsible for complying with any and all such laws. By selling and shipping the device to GadgetLifeline.com.com, you acknowledge and agree that you are the authorized owner of the device, and:
(1) shall not infringe on third-party intellectual property rights (including copyrights, trademarks, patents, trade secrets or other proprietary rights),
(2) shall not be counterfeit, stolen, or fraudulent,
(3) must be able to transfer the device to a new owner. Once the payment for your device is processed, it goes for recycling and cannot be returned. Should we discover any misrepresentation in ownership or identification, we may reject to process the payment.
The value of your device depreciates with time. The depreciation is calculated based on the following terms:
1. The device will be considered “Flawless” if the model launch date and the purchase date of the device is not more than 6 months.
2. The device will be considered “Good” if the model launch date and the purchase date of the device is not more than 12 months.
3. The device will be considered “Fair” if the model lunch date and the purchase date of the device is not more than 24 months.
4. The device will be considered “Poor” if the model launch date and the purchase date of the device is more than 36 months and higher.
Indemnity and Warranty
You agree that you represent and warrant that the trade-in devices are free of any liens or encumbrances, including third-party software which may not be transferred or for which royalties are due. By using our Service, you agree to indemnify the Company from all claims or losses sustained by us as a result of your breach of this warranty.
We allow shipped devices to be returned to you for free with a few exceptions:
a. If you have selected the wrong model and got the wrong estimate. After receiving the device we will provide you with a new estimate, because it was the wrong model or device, and if you reject the new estimate, then you must pay the shipping cost in advance for us to ship the device back to you.
b. If you change your mind and don’t want to sell your device during or after receiving the revised valuation, then you can get your device sent back to you after you pay for the shipping cost in advance.
c. If your device has accounts that are passcode locked or fingerprint locked, and has sensitive information which you don’t want us to access. You can get your device sent back to you after paying shipping cost in advance.
Trade-in Service is based on accurate descriptions of a device and honest pricing estimate. GadgetLifeline.com.com will release payments based on the following:
a. Payments will be issued based on the receipt and assessment of your device based on the description provided by you initially. If the condition matches when we receive the device, then payment will be issued immediately. If it doesn’t match then, we’ll hold payment, and wait for your approval on revised estimate sent to you via email after revaluation.
b. Payment will be made via PayPal, Venmo and Check. You are responsible for providing accurate payee account information including official name, email ID, account number, phone number, etc. Should you provide the wrong payee information, immediately contact our team and provide us with the correct ones. If payment is made to the wrong account, email, address, or got lost in the mail then, we will hold the payment until the lost payment is first recovered. In case of a bank check, we will first cancel the first check then a new one will be issued. All checks are voided after 90 days so make sure you cash it within this period of time. After the check is voided, we are not legally required to re-issue.Since Venmo limits transactions up to $200, for higher amounts we recommend you opt for PayPal or Check.
For all payments always make sure you double-check payee information before confirming payment.
c. If your device is locked with BIOS password, fingerprint, or has certain account passcodes for the device for which payment is already made to the customer, we may request you to refund the payment immediately. GadgetLifeline.com.com also reserves the right to file a claim, hold the check payment or dispute the payment if made through PayPal or Venmo.
You agree and indemnify the Company for any risk-of-loss for the trade-in device until we receive the device. You agree you are responsible for any damages that may occur in transit and the loss will not pass on to GadgetLifeline.com.com. If we refuse a product due to misrepresentation or inaccurate description, then you bear the risk-of-loss pursuant to your request for the return of the device to you.
You agree that trade-in offer is non-transferrable, non-redeemable for any other device quote and it is non-refundable.
You agree that once you accept the price estimate, then you cannot avail the new pricing which GadgetLifeline.com.com may change on their website without prior notice.
a. Entire Terms/No Waiver. These Terms constitute the entire agreement of the parties with respect to the subject matter hereof. No waiver by Company of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.
b. Correction of Errors and Inaccuracies. The Content may contain typographical errors or other errors or inaccuracies and may not be complete or current. The Company therefore reserves the right to correct any errors, inaccuracies or omissions and to change or update the Content at any time without prior notice.
c. Modification. The Company reserves the right to modify these Terms at any time without giving you prior notice. Your use of the Service and following any such modification constitutes your agreement to follow and be bound by the Terms as modified. The last date these Terms of Service were revised is set forth below. Terms and conditions modifying the Agreement are effective immediately upon posting.
THESE TERMS AND CONDITIONS ARE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH PENNSYLVANIA LAW, AND NO CONFLICT OF LAWS OR PROVISIONS OF ANY JURISDICTION WILL APPLY TO THESE TERMS AND CONDITIONS. BY CHECKING THE BOX "I ACCEPT THE TERMS OF SERVICE" ON THE SUBMISSION FORM, YOU AGREE THAT ANY ACTION AT LAW OR INEQUITY ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS WILL BE FILED ONLY IN STATE OR FEDERAL COURT LOCATED IN PENNSYLVANIA, UNITED STATES OF AMERICA, AND YOU HEREBY IRREVOCABLY AND UNCONDITIONALLY CONSENT AND SUBMIT TO THE EXCLUSIVE JURISDICTION OF SUCH COURTS OVER ANY SUIT, ACTION, OR PROCEEDING ARISING OUT OF THESE TERMS AND CONDITIONS.
